Please join the Runnymede Society’s McGill Student Chapter for a talk on the notwithstanding clause, with brief reflections on free speech in academia, by Prof. Geoff Sigalet (UBCO) on Friday, October 3rd!

Prof. Sigalet will make the legal and political case against the judicial review of laws that invoke the notwithstanding clause. Prof. Sigalet will explain why provinces have been more willing to use the notwithstanding clause since 2018, argue against the Attorney General of Canada’s factum in English Montreal School Board (Hak) v A.G. Quebec that its text prevents substantive judicial review (including limits on renewal), and reiterate why such review would be wrong and unwise even if it were possible.
